Goldstone: If I Had Known Then What I Know Now…

Judge Richard Goldstone, head of the infamous UN panel that issued the Goldstone Report in 2009, backtracked on his most serious accusations on Friday.
The Goldstone Report had accused Israel and Hamas of “actions amounting to war crimes, possibly crimes against humanity” during the 2008 Gaza War.
Goldstone’s about-face includes a reversal on the contentious claim that Israel intentionally targeted Palestinian civilians.
Investigations into some 400 incidents from the war, cited by another recent UN report, “indicate that civilians were not intentionally targeted as a matter of policy,” Goldstone wrote in an op-ed published in the Washington Post:
“I regret that our fact-finding mission did not have such evidence explaining the circumstances in which we said civilians in Gaza were targeted, because it probably would have influenced our findings about intentionality and war crimes.”
Goldstone starkly admitted, “If I had known then what I know now, the Goldstone Report would have been a different document.”
Despite the mea culpa, Goldstone repeated his excuse that his work was hindered by Israel’s refusal to cooperate with his investigation, conceding however, that the UN Human Rights Council, which sponsored his report, has a “history of bias against Israel [that] cannot be doubted.”
But according to Jerusalem Post editor David Horovitz, commenting on Goldstone’s latest revelations, Goldstone should not have been surprised by Israel’s decision not to cooperate with his mission:
To have formally subjected itself to examination by his committee and the institutionally biased UN Human Rights Council that had formed it – a bias which Goldstone now acknowledges in his article – would merely have given his work greater purported credibility.
Notwithstanding that absent formal cooperation, however, the truth about what happened in Gaza in December 2008 and January 2009 – the truth that Goldstone now disingenuously claims to have discovered only after he filed his malicious indictment of the IDF and of Israel – was readily available to him at the time.
Israel did informally make the necessary information available to his committee in the shape of detailed reports on what had unfolded. And open sources, honestly evaluated, left no doubt that Hamas was the provocateur, that Hamas was deliberately placing Palestinians in harm’s way, that Hamas was lying about the proportion of combatants among the Gaza dead.
Indeed, Honestreporting first reported on the fallacies and false accusations in the Goldstone Report back in September of 2009 using information that was available to the public. HonestReporting also provided a long list of resources for countering the report, all of which drew on public sources.
Along with accusations of war crimes, Goldstone’s op-ed also puts an end to the dispute over casualty figures.
While the Goldstone Report cited civilian casualty numbers obtained from Hamas, which were considerably higher than the IDF’s figures, Goldstone now admits that “the Israeli military’s numbers have turned out to be similar to those recently furnished by Hamas” (emphasis added), adding however, that Hamas may now be exaggerating the number of terrorists killed by the IDF.
Put simply, the IDF’s figures were correct all along.
But it remains to be seen if the media recognizes that the commonly quoted numbers of “1,400 dead, including mostly civilians” – cited by the Goldstone Report – are inaccurate. The caption for the following image, taken from BBC’s coverage of Goldstone’s revelations, shows that the Beeb has yet to assimilate the new information.

In an exclusive comment to HonestReporting, Hillel Neuer, the executive director of UN Watch, called on the UN to take decisive action in light of Goldstone’s revelations.
Now that the core finding of the Goldstone Report has been discredited by its author, the norms of international law, ethics, and morality require Judge Goldstone to urgently request the UN Human Rights Council to convene a special session to officially repudiate the report and halt its ongoing proceedings to implement it.
An op-ed is not enough. Goldstone must officially inform all other bodies which received his false report: the UN Security Council, the UN General Assembly, the International Criminal Court, and all the 192 UN member states which — based on his recommendations — were officially asked by the world body to open criminal prosecutions of Israeli leaders and officers.
Goldstone must also write to the Swiss government to call off their effort, based on the Goldstone Report, to convene an international conference of the Geneva Convention signatories to condemn Israel. Goldstone will never be able to undo the poisonous anti-Israel libel that he spread around the globe, but as a judge we call on him to do the bare minimum that legal ethics and common sense require.
While most of the mainstream media has covered the story, two of Goldstone’s biggest cheerleaders , The Guardian and The Independent have yet to report on the about-face. In particular, The Guardian’s over-reporting of Israel — as expressed by this map produced by British Views of the World (read more background and signficance) – behooves the paper to follow through.

Goldstone’s commentary was published on Friday, and yet as we go to press, neither paper has picked up on the story.
It is impossible to know exactly what prompted Goldstone to reverse his positions at this time. But one thing is certain: it couldn’t have happened without the many people who refused to accept the Goldstone Report’s false conclusions and continued to fight in the public arena. Everyone who spoke out against the report deserves a share in the credit for bringing the truth to the surface, however delayed.
The fight, however, is far from over. The Goldstone Report has caused great damage since its publication nearly two years ago. It is now up to the media to promote the truth about the Gaza war with the same intensity it promoted the conclusions of the Goldstone Report. And it is up to all of us to hold the media to account to ensure the truth is revealed.

The Talmud teaches that destroying someone’s reputation is akin to murder. What if that “someone” is a whole nation, the Jewish state of Israel? Isn’t then the murder raised to the level of “collective assassination”? Isn’t that really the definition of “genocide”?
Therefore, the least that should be done is indict Goldstone for malpractice and, perhaps, for “second-degree genocide” if there is such a legal precedent. But whatever the case, no crime should go unpunished, and Goldstone’s crime is abhorrent.

Goldstone is an idiot. I wish I could show more respect for someone who is a respected judge, but not this one. He is a foolish man and he can repent all he wants, having fulfilled his role as the useful idiot, he is confined to the dustbin of history. A person who had spoken falsely and harmfully about another, asked a Rabbi, “what should I do to make amends?”
The Rabbi told him to tear open a pillow and scatter the feathers. When he had done that he asked the Rabbi, “Now what should I do?” The Rabbi said, “Now put them back.”
Although Goldstone can never put the feathers back, he can make a strong and determined effort to tell the world how he had wronged Israel and the Jewish people, (excluding those non-Jewish Jews of his ilk) He should launch a detrmined worldwide campaign to tell the truth and disclose his motives and mindset when he spread his poison.
If he has trouble getting attention he should follow the advice of a previous writer and jump off a (suitably high) bridge.
That would get him attention and show his sincerety.

I read the article in the Washington post and learned that Goldstone still does not know anything. He say that Hamas did not conduct any investigation regarding it’s firing the rockets at Israeli civilians.
When Mr Goldstone, you are dead wrong !! They sure did conduct an investigation, only it’s main question was how did we fire so many rockets, shells and mortars and killed so few?
Dam, we got to get some better weapons and training, getting much more “effective”.
And they sure did !!

I´ve read on Goldstone´s role in South Africa. A little.
I understood this.
His contribution against apartheid was very important. Mainly, due to several facts:
1) He was against apartheid, a bloody regime.
2) He was white.
3) He was a white judge against apartheid.
4) He was a Jewish white judge against apartheid.
5) He was a Jewish white judge against apartheid, setting free prisoners, hiring a black clerk, making investigations on that era during the post apartheid years in the Goldstone Commission in South Africa, etc.
6) Due to his role, he was apointed to investigate crimes in the Yugoslavian war, and others.
7) All this reputation, made the UN Human Rights Council to apoint him to investigate the Gaza war. 2009.
Interesting that, a prominent UN organism, whose task is to defend the human rights, chose a prominent judge in the world. A Jewish judge, that had participated in the most prominent conflicts in the last 25 years. A Jewish judge that have been looking for the defense of the human rights in several parts of the world.
What then?
The Commission that the Jewish judge headed, generates a report that made a very huge damage on Israel.
Now, he´s falling in the fact that, in some extent, some of that information was wrong. Due to the same words he told: “If I had known then what I know now, the Goldstone Report would have been a different document.”
All the fingers point now at judge Goldstone.
No finger points at all at the group of persons who apointed him as head of the comission: the UNHRC. The organism within the United Nations.
And, perhaps, some other people among them.
How to reject such a prestigious appointment? How to reject a chance to be a judge, being Jewish, on an issue where the IDF is implicated? By rejecting the offering: Wouldn´t be interpreted as a rejection on the basis that, being a Jewish judge, he was not dare to judge the actions of his own people? I mean, if rejected the offer, the interpretation surely had been: “You didn´t want to risk (or have the courage) to judge this issue with Israel, because you are Jew. You are judge, but not brave enough to judge your own people.”
And, by choosing to be the head of the comission the UNHRC, he fell in a trap: a Jew, used as instrument by others, to damage Jews. This has happened many times in History.
Now, what?
To blame this man, even though all the damage the report did (specially used by those people who always condemns Israel), is not intelligent.
Not only this fact. If this man, as a source said, “spent many days and “sleepless nights” deciding whether to accept the mandate, saying that it had come as “quite a shock” ” : To head this charge was a shock. To reverse those very conclusions on the report he himself approved, is a very huge and harsh shock. NOW.
You can read this quote on Wikipedia. Surely, this can be found in other sources. This one is at hand.
What to do?
Not to condemn so easy.
To understand that a very prominent Jewish judge was used by those who put traps to Israel in order to make him to fall. To fall in the trap, and to clash against his own people. It´s necessary to understand the kind of game played. Goldstone and Israel clashing, but, Who provoked this clash? It´s necessary to understand the game involved.
To use the fact, although painful, that this situation can be used to demonstrate that there is a very active campaign against Israel, even if a dry leaf is cut from the nation from a tree. And that, this campaign can come, even inside from the very UN.
Unbelievable?
What people opened the UN doors to Yasser Arafat, when he spoke on the general assembly, saying: “Do not let the olive branch to fall from my hand”? And that was before or after the Munich massacre? Before or after the palestinian revolt that almost set a civilian war in Jordan in 1970?
Before or after the Lebanon war in 1975, whose responsibility fall in the revolts made by palestinians, amongst other groups?
So, there´s a kind of status quo that do not dare to clean things inside some organizations. This could include the UN. The signals point toward this fact, in a very heavy way. And to act in a very cleaver way on certain issues, as to provoke a clash among Jews. Is almost to kill two birds with one stone.
Knowing that this fact could become a very deep trauma for a Jew, then, this demonstration of rectifying can come from judge Goldstone himself. He headed an action against Israel, he perfectly can head an action to clean Israel, and to demonstrate that the palestinian manipulations, along with the media, exerted and influenced the reasoning and drove the conclusions to their destructive trends.
I read in a posting that judge Goldstone should make suicide. That´s the worst thing shown. Don´t you consider that the enemies of the Jewish people should be eager to watch such a thing, and that they could jump of joy watching Jews inflicting damage to other Jews?
No. That´s not the path. The right one, among several, is to stand with honor, to recognize the actions made with the very subtle trap put ahead of the judge, and to correct everything. To make real justice. Toward himself, judge Goldstone, and toward Israel.
To recognize and to rectify brings clean things. Easy like that.
And to uncover the real deems from the enemies of Israel. Wisely. Not fanatically but wisely. Under the light of the truth. Truth. Only that.
In this case, is much better to show mercy. Mercy among brothers. To heal the wounds. And, of course, to strength the one to each other. To show honor and righteousness, a thing the enemies of Israel do not show.
Not doing this, is to become LIKE THEM.
To avoid any kind of poison is necessary in order to avoid the same poison that make them to act as they do against Israel.
This reminded to me what happened to Hakoah in Austria. As they strengthened to each other under the shadows of the evil coming, it should be the same now. NOW.

Goldstone should have never take the job. Simply because of the mandat: to investigate all violations that took place in Gaza. Nothing about war crimes that the Gazans caused by firing rockets to Israel.
As for the UN body? Are you serious? Lybia is a member at this body. President Bush had nothing to do with them. They are a bunch of hypocrites and anti jews/Israel. No good will come out of whistle blowing for that so called ‘human right’ body.

The Goldstone Report was well documented and came from numerous authors and sources. The information regarding Israeli and Hamas war crimes in Gaza is solid, and I await new facts from Goldstone to rebut what was written. To be honest, I expect that there will be nothing or nearly nothing. Goldstone may not have written the op-ed himself because the tone of the writing is radically different from previous, confident interviews that he has given.
He made reference to the Itamar murders which was out-of-context and out-of-place in the report, because the murderer has not been found yet. This is not how a distinguished jurist behaves. Goldstone wrote the op-ed because he was worn down by the South Africa Zionist Federation. The chairman wrote, “he suffered greatly, particularly in the city he comes from…” http://www.ynetnews.com/articles/0,7340,L-4051403,00.html .
Israel and the Jewish people shows a true Jewish spirit by telling the strict truth and examining what it is doing. These are very very hard times for the Jewish spirit that I grew up with and that I am so proud of. I want the words best associated with Jewish behavior to be more like “mensch”, and “haimisch”, not “La Cosa Nostra”.

I knew what I was talking about when I said it, just like Goldstone. My original comment was erased. It used to be next to Harvey Rogers up top. Now it’s not there. It had a -6 rating, when I last saw it. Just to ask all of the commenters here, isn’t there any sense of the morality that you grew up with, if you went to Hebrew school? Goldstone produces a report with other distinguished individuals, that is full of documentation about Israeli and Hamas war crimes. This is very damaging to Israel, more so than Hamas. Well, are you interested in honesty or not? Do you want to behave like the Soviets used to, just lie through their teeth? That’s the way that a country goes down the drain.

“Judge” Goldstone was used to the law system of old South Africa, a racist regime with racist laws, under strong censorship. Every kindergaden kid knew, by the time of the Goldstone report, what was the true. He did not expected a reaction within the jewish community. Why? He was used to send africans to imprisonement for life or to the gallows under a legal system wich was not excatly legal; and he was used to act like an untouchable superman.
He is probably now a pariah within the jewish community of South Africa and through the world. And, I guess, as it is always done with every jew, he is not sheltered anymore after the dirty work was done. As well as is never invited to Shabbat meal or even to a Seder on one side, on the other side he is nothing more than nothing within his former sponsors, whomever they are.
His op-ed is good for nothing. Why?
If someone says to me that I am a “son of ……” in front of my mother, apologies to my mother are useless.

No Jews left in any Arab states they’re all absorbed by Israel while Arab states refuse to absorb the refugees they created. Israel include Arabs that are about third of it’s citizens. They get elected, are judges. One of them read the sentence of a former President of Israel! Yet many people are ignorant and call Israel an Apartheid state. The PLO’s charter is the destruction of Israel. In the PLO there is Abbas Fatah and Hamas both have their own charter describing their reason for existing: The destruction of Israel. Then there is Iran, Hitzbollah with their missiles raining on Israel. So if someone has to change, it is the Arab states and Iran in order to have peace with Israel. Notice that Iran, a member of the UN declared openly that it aims to destroy Israel while manufacturing missiles and nuclear weapons in order to do their despicable aim. No one attempts to throw Iran out of the UN for this crime against the very UN charter’s aims.

Apartheid in Israel usually refers to the Occupied Territories, pre-67 Israel is best described as Jim Crow, like in the American South, not Apartheid. Do you consider Wikipedia a trusted source? Anybody can post there. It has no validity whatsoever.

Robert, read your WiKi source well. It say in the header
“This article needs references that appear in reliable third-party publications. Primary sources or sources affiliated with the subject are generally not sufficient for a Wikipedia article. Please add more appropriate citations from reliable sources. (December 2009)”
This WiKi entry is about a book some guy wrote. It does not make it true. Just by reading the first few lies in the beginning “the forced relocation of close to 800,000 Palestinians…” I can tell you those numbers are totally wrong and also the facts. The truth is that the attacking Arab countries told the Arabs to leave their homes only to return later after they finish off with the Jews.
I know this at first hand, from my parents and family who lived in Israel at the time. I do not need any Wiki internet lies. the small population of 600,000 Jews in Israel in 1948 were simply facing another Holocaust and fought for their life. That is the truth!
