I reached the same conclusion as did the Levy Committee before they did. My legal opinion is available in a two part op ed printed in Arutz Sheva. I tried to put this view before students at Harvard in a conference held March 3,4, 2012 and before students at UCLA on May 15 but did not succeed either in getting on the panel of the Conference on a one state solution of the Arab Israel conflict, or in getting permission to write my views in an op ed in the Harvard Crimson or the Daily Bruin. I published them in an ad in the Crimson but at UCLA got no reply to my request. The Levy Report is correct.
After the Independence War, the West Bank was declared to be disputed territory whose status would be determined by negotiation at some later date. That is, area within the green line was clearly Israeli; area within the red line was clearly Jordanian; and area between the lines—primarily the West Bank—was in question.
The disputed territory was put under Arab administrative control, but never given to the Arabs.
Thus, it cannot be considered ‘occupied’ territory.

Is Kashmir occupied or disputed?
Are Judea and Samaria occupied or disputed?
Is the entire State of Israel “occupied?”
Yes, if you listen to the Arabs that want to “take back their land” mean every square centimeter of the State of Israel!
The “West Bank” was given that name by the unlawful occupation of Jordan, why Israel still uses that moniker is beyond my ability to understand. Look at the word Judea. Why are the Jewish people called Jews? Judea…Jew. Hmmm…
Mistakes have been made in the past, disastrous mistakes. Sigh…
